Internet Terms & Conditions

This agreement represents the complete agreement and understanding between South Island Cable Ltd, (hereinafter called South Island Cable) and the customer (hereinafter called CUSTOMER) and supersedes any other written or oral agreement. Upon notice published on-line via South Island Cable, South Island Cable may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change the services offered. Submission of your account order shall constitute your acceptance of these Terms and Conditions.

1. A completed application form is required for all access to South Island Cable and South Island Cable reserves the right to reject any applications.

2. The setup fee is non-refundable, and must be included with the application form at time of processing.

3. If the cable modem provided for the use of the internet subscriber by South Island Cable, it remains the property of, and must be returned to South Island Cable , the full market value of $149.00 will immediately become due and payable by the internet subscriber.

4. Users of the South Island Cable system are not allowed to re-sell access to services accessed via South Island Cable unless a separate reseller agreement is signed.

5. Users of the South Island Cable system are not allowed to serve files in any way via South Island Cable Systems unless a separate agreement is signed. (Acceptable Use Policy)

6. South Island Cable is not responsible for any system damage, loss of data, or loss of business due to files or data retrieved from South Island Cable

7. South Island Cable reserves the right to terminate/restrict any access at any time for any reason. Our sole liability will be the refund of any unused portion of the monthly and/or modem rental fees; South Island Cable makes no claim as to providing guaranteed minimum/constant bandwidth and service may vary subject to subscriber usage.

8. Because the Internet is a global community consisting of members from many countries with varying local laws and customs, it is possible to access material of questionable content. South Island Cable is not responsible for this material. Parents are expected to supervise their children's use of the internet.

9. To terminate your account, we require a minimum of 5 days prior written notice. Refunds over $5 will be mailed.

10. South Island Cable does all Internet billing in accordance with its standard billing and payment policies.

11. A credit card number will be provided that will only be used in the event the applicant fails to pay the rental or does not return the rented modem when the contract is terminated.

12. Data transfer usage exceeding what is provided in your specific internet package may be charged to your account at a rate of $2.50for every extra 1 GB you use.

Exclusion of Liability
In no event shall South Island Cable or its employees, agents or servants be liable for any damages, direct or indirect, consequential or otherwise, including, without limitation, system damages, loss of data, loss of business or damages for loss of business profits, business interruption or loss of business information and whether the same arise in contract or in tort or arise by reason of anything done or omitted to be done by or on behalf of the said South Island Cable.
